After 12am, are protests prohibited? If you’ve been watching the protests play out in Portland, you’ll notice around 11:45pm that the Portland Police will declare the protest an “Unlawful Assembly.”
What is an Unlawful Assembly?
Authorization to issue an order to prohibit the assembly of four or more people in an area. According to the law, every member of such ‘unlawful assembly’ can be booked for engaging in rioting. The meeting of three or more persons may constitute an unlawful assembly if the persons have an illegal purpose or if their meeting will breach the public peace of the community. The FIRST AMENDMENT to the U.S. Constitution guarantees individuals the right of freedom of assembly.
What are the reasons that the Portland Police declare protests an Unlawful Assembly?
Police declare the gatherings of thousands of protesters outside the Justice Center “an unlawful assembly and civil disturbance” after they say demonstrators began throwing objects at police.
Why are Protesters throwing objects at Portland Police?
Police brutality and police using chemical weapons/projectiles against protesters are the main reasons for the public’s aggression towards the police.
How can we protest all night and bring back the Occupy-style protests if Portland Police are gassing/shooting everyone past 12am?
There must be a safe place in which protesters can re-gather after the gassing, a safe place in which they can regroup without increased police violence. Typically when the crowd is gassed, the Portland Police will sweep the streets and demand that everyone go home immediately or be subject to arrest.
